Grand Jury Indicts Geneva Man In Wife's Death

ST. CHARLES (CBS) -- A grand jury has indicted Shadwick King on two counts of murder in the July death of his wife in west suburban Geneva, the Elgin Courier News is reporting.

King, 47, is accused of killing his wife "by means of asphyxia" on July 6. Kathleen King's body was found on the Union Pacific railroad tracks south of Esping Park not far from the couple's home on Oak Street, according to authorities and the indictment.

King remains held in Kane County Jail on $1.5 million bail with arraignment scheduled for Sept. 24. King has filed a speedy trial request and is currently set for trial in early December.

Prosecutors have said the couple argued about text messages Kathleen exchanged with another man, prompting prosecutors to request phone record information to help track her phone use in the hours before her death. Court records show the couple, which had been married for 10 years, filed for bankruptcy in 2013, while their home went into foreclosure in 2011 and 2012.

The couple failed to make payments on their Oak Street home for six months in 2011 before the bank sought foreclosure. A payment agreement ended those proceedings, but a new foreclosure filing was initiated in 2012 after four months of missed payments on the original $198,000 mortgage obtained in 2007, according to court documents. That case has a January court date scheduled.

The 2013 bankruptcy filing indicates the couple sought a repayment plan to aid them with nearly $324,000 in liabilities that included the mortgage, unpaid taxes and student loan debt. The case was dismissed about a year ago when the couple did not make required payments.
