East Chicago Councilman Jailed On Murder Charge -- Now What?
(CBS) -- One councilman's legal trouble has created real problems for East Chicago, Ind.
And even though Robert Battle is in jail, accused of murder, there's no easy way to get him out of office.
Officials don't know what to do, CBS 2's Mike Parker reports.
State law allows Battle to continue in office.
During Wednesday's City Council meeting, Reimundo Camarillo railed against the fact that Councilman Battle is still on the council drawing full pay as he awaits trial for the murder of Camarillo's son.
"I'm still paying taxes and he's using the money for an attorney," Camarillo said.
On Thursday, the lawyer for the East Chicago City Council decried the loopholes in state law that prevents Battle from being barred from office. It can't happen unless, or until, Battle is convicted.
"(State law) does not address an elected official charged with a serious felony and held without bail," Stephen Bower tells Parker.
Battle continues to draw his $42,000 annual salary while still behind bars. The dilemma is the talk of the town.
"The Third District is getting cheated and the taxpayer is getting cheated," Cathy Serrano says.
Now, the city is looking into possibly using the jail's video visitation system to allow Battle to monitor council meetings.
One problem: State law would not allow Battle to vote.
