BOSTON (CBS) – An Uber driver facing charges for allegedly raping a woman on the Esplanade in Boston cried during his arraignment, and was eventually ordered held on $100,000 cash bail.

Boston Police say Daudah raped a woman around 1:15 a.m. Saturday in the area of the Esplanade. The woman was taken to the hospital for treatment.

Immigration and Customs Enforcement said on Sunday they had placed a detainer on the Ugandan citizen following his arrest. But on Monday, ICE said Daudah is "not subject to removal at this time."

Prosecutors said at Daudah's arraignment that he raped the woman twice on Storrow Drive, once while the car was moving. According to the prosecution, the woman's phone rang, which allowed her to escape.

A bystander saw the woman run away crying.

A defense attorney told the judge Daudah is a father of 12 children, including three sets of twins. While his attorney spoke, Daudah began to loudly cry and speak in a high pitch. The judge responded by telling him to "knock it off."

The judge set Daudah's bail at $100,000 and ordered him to surrender his passport. Daudah must also wear a GPS monitor if he makes bail.

Daudah is next scheduled to appear in court on May 1.
