Man Charged In Firing Of Gun Outside Taj Hotel Held On $30K Bail

BOSTON (CBS) -- Police arrested a man they say fired a gun outside a Back Bay hotel and in a taxi cab Monday night.

Andrew Flack, 34, of Orlando, Florida, was arraigned in Boston Municipal Court Tuesday on charges of unlawful possession of a firearm, unlawful possession of ammunition, and discharging a firearm within 500 feet of a dwelling. He was held on $30,000 bail.

Police responded to a call regarding a person with a gun and shots fired around 10:20 p.m. Monday near the Taj Hotel on Arlington Street. An employee said a bar patron who police later identified as Flack attempted to leave the building with his drink. When the man was told he couldn't take the drink outside, he became angry and smashed his glass. Police were told he then exited the building, pulled out a gun, and fired before fleeing on foot.

Police said they were able to identify Flack because he left his credit card and unpaid tab at the bar.

After responding to a second call of shots fired on Massachusetts Avenue, police and SWAT officers found and arrested Flack. Police said Flack had gotten into a taxi after the Taj incident, and fired his weapon from inside the cab as it drove on Mass. Ave. They said Flack got out of the taxi and ran away as they converged on him, but was later caught near the intersection of Mass. Ave and Albany Street.

A loaded handgun was found in the back seat of the cab.

There were no injuries resulting from either of the times the man fired his gun.

Flack was also ordered to wear a GPS monitor, abide by curfew, and remain alcohol-free if he is released on bail. He is scheduled to return to court on February 23.
