Peabody Man Charged In Everett Store Robbery, Shooting

BOSTON (CBS) -- One of the two men wanted for robbing and shooting an elderly store clerk last month in Everett is behind bars tonight.

On Monday, the clerk made a short visit to the scene of the crime.

"Two shots… two shots," he said

Motioning with his hand, the 66-year-old man who speaks very little English paid a brief visit to the Everett convenience store, showing off the wounds from that frightening night.

Mafizur Kahn spoke to us as his nephew, Shalauddin Kahn, interpreted.

"After the incident happened, he can't sleep at night. He still is having a dream that someone is coming and shooting him," Kahn said.

It was Monday night February 17, when two men tried to rob the Main Street store, shooting the clerk twice in the process.

One of the two men who police say barged into the store was in front of a judge in Malden district court, Monday.

Fifty-two-year-old Gary Greene of Peabody is charged with assault and battery with a dangerous weapon and is being held without bail. He was arrested at an apartment in Swampscott, last night. But in court investigators admitted Greene was not the trigger man. A second man is still on the run.

"This defendant is not alleged to be the shooter. He is not alleged to the individual with the fire arm," Defense Attorney Cheryl McGillivray told the judge.

Prosecutors say it was Greene's daughter who actually called police when she saw his picture on television news.

In the meantime the victim says the gunman was trying to shoot him in the head but he deflected his hand at the last second.

"He hit him with a stick and that is why the gun go down and shoot him in the stomach," Kahn's newphew told WBZ-TV. "He is hoping that the other guy, the shooter, is arrested soon because until then he is not feeling safe."

Kahn says he has a long way to go until he is fully recovered. He says he is not sure when he will return to work at the store.
